Terms of Use

Last updated [PLACEHOLDER: date]. Operated by [PLACEHOLDER: legal entity name and registered address] (“we”, “us”).

These terms cover your use of HardGaming Forums. By reading, posting or signing in, you agree to them. If you do not, please do not use the forum.

1. Who may use the forum

You must be at least [PLACEHOLDER: minimum age, e.g. 16] to hold an account. Reading the forum does not require one.

2. Accounts

Accounts are not created here. Registration, password changes and account deletion are handled on the main website, and the terms that apply to your account itself are the ones published there. This forum signs you in with those credentials and does not hold your password.

You are responsible for what happens under your account. Tell us at [PLACEHOLDER: contact address] if you believe somebody else has access to it.

3. Acceptable use

What is and is not acceptable is set out in the Community Guidelines, which form part of these terms. In addition, you agree not to:

  • break the law, infringe anyone's rights, or post material you do not have the right to post;
  • attempt to gain access to accounts, data or systems you are not authorised to reach, or to probe, scan or disrupt the service;
  • scrape or bulk-download the forum by automated means beyond what robots.txt permits, or resell its content;
  • upload anything designed to damage a reader's device or data;
  • impersonate another person, a moderator, or us.

4. Your content stays yours

You keep ownership of everything you post. So that the forum can function, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, reproduce and distribute what you post, and to make the formatting changes that publishing it requires. That licence exists for the purpose of running and promoting the forum and lasts as long as the content is on it.

Posts are public and they persist. A thread is written to be found later by somebody with the same question, and other members' replies build on yours. Removing a post that has been replied to may therefore leave the replies in place. Copies may also survive outside our control — in search engine caches, in archives, and in the browsers of people who read it.

You confirm that you have the right to post what you post, and that it does not infringe anyone else's rights.

5. Moderation

We may remove content, lock threads, issue warnings and suspend or terminate accounts, with or without notice, where we consider it necessary to enforce these terms or the Community Guidelines. Content may also be hidden automatically pending review; the guidelines explain when and why.

We are not obliged to monitor content and do not endorse it. Advice on this forum is written by other members: acting on it is your decision, and that includes anything concerning hardware, firmware, overclocking or purchases.

6. Availability

The forum is provided on an “as is” and “as available” basis. We do not promise it will be uninterrupted, and we may change, suspend or discontinue any part of it.

7. Liability

To the fullest extent permitted by law, we exclude all implied warranties, and we are not liable for indirect or consequential loss, loss of data, or loss of profit arising from your use of the forum or from anything posted on it by another member. Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud.

[PLACEHOLDER: any liability cap, if one applies.]

8. Third-party content and links

Posts may embed images or link to other sites. We do not control those and are not responsible for them. An image hosted elsewhere is fetched by your browser from that host when you view the post.

9. Termination

You may stop using the forum at any time; account deletion is handled on the main website. We may suspend or terminate your access where you have broken these terms. Sections 4, 7 and 10 survive termination.

10. Governing law

These terms are governed by the laws of [PLACEHOLDER: jurisdiction], and the courts of [PLACEHOLDER: jurisdiction] have exclusive jurisdiction, without affecting any mandatory rights you have under the law of the country you live in.

11. Changes to these terms

We may update these terms. The date at the top changes when we do, and material changes will be announced on the forum. Continuing to use the forum after a change means you accept it.
